Terms of use (AGB) for the online publication platform of Shaker Publishing

§ 1 Preliminary remark
|
Shaker Verlag GmbH – 52018 Aachen
- hereinafter referred to as the "publishers" -
offers authors of scientific contents
- hereinafter referred to as the "author" –

to publish and market scientific and academic publications, in particular
research reports, habilitation, dissertation, diploma, bachelor and magister
theses, outstanding assignments and seminar papers as well as other theses or
papers. This offer is addressed to authors who have written an academic or
scientific paper at a university, research institute, company or institution
with academic supervision and who have had this graded and accepted by an
examination committee, professor, university lecturer or tutor.

The following terms of use apply exclusively for the use of the online platform
by the author.

§ 2 Manuscript delivery
|
The author offers the publishers academic or scientific manuscripts for
publication. The delivery of manuscripts to the publishers represents an offer
on the part of the author for publication by the publishers. The publishers are,
however, only obliged to publish the manuscript following conclusion of a
separate, written author-publisher agreement. This will be sent to the author
after the publishers have examined the manuscript. A sample of this
author-publisher agreement can be found on the publisher's Internet pages www.shaker.de or
www.shaker.eu and is thus placed at the author's disposal in advance. Irrespective of this,
the author agrees to only submit manuscripts for examination to which he or she
holds the copyright, which he or she is entitled to dispose of freely and whose
contents do no violate the rights of any third part or statutory regulations.
Furthermore, the author will only submit transcripts or copies of the original
manuscript to the publishers. The manuscript will not be returned to the author
following examination and/or publication. The author is not entitled to a return
of the manuscript. If the submitted manuscript is lost or damaged the author is
not entitled to reimbursement of the costs of production or to a material or
idealistic value of the manuscript.

§ 3 Data protection
|
The author agrees to the storage of his or her personal data. The stored data
will only be collected, processed and used wherever this is necessary for the
substantiation, formulation or amendment of the author-publisher agreement and
its implementation by the publishers. The publishers have informed the author in
detail of the extent and purpose of the collection, processing and use of his or
her data as needed for the implementation of the author-publisher agreement. The
author expressly agrees to the collection, processing and use of his or her data
wherever his or her consent is needed in individual cases.

§ 4 4 Safety; access rights
|
During registration with the online publication platform of Shaker Publishers,
the author will be asked to choose a user name and password. It is the sole
responsibility of the author to keep this access code secret. The author agrees
never to disclose the account, user name or password to third parties.
Furthermore, the author agrees to inform Shaker Publishers immediately if they
suspect that his or her account has been used without authorisation or a third
party has access to their password and/or account.
Shaker Publishers is entitled to remove faulty and/or malicious files and is
also entitled to disable an account or the author's access if it suspects a
misuse, an incorrect or technically faulty use or that faulty and/or malicious
files have been transferred.

§ 5 Final provisions
|
German law shall be exclusively
applicable for all disputes arising from the use of the publisher's online
publication platform. Sole place of jurisdiction is the publisher's place of
business.
